DMCA TAKEDOWN POLICY

The Real Crime Diary (“we”, “us” or “our/the website”) respects the intellectual property rights of others. We aim to honor these rights and expect our users to do the same. This document outlines the procedure for submitting a Digital Millennium Copyright Act (DMCA) takedown request to us regarding content hosted or published on The Real Crime Diary website.

Submitting a DMCA Takedown Request

If you believe that a certain webpage or content contained on our website infringes your copyright or trademark right, please notify us by submitting a Takedown Request as set out below.

To submit a DMCA takedown request, the copyright holder or their authorized agent must provide the following information in writing:

  1. Contact Information: The full name, address, telephone number, and email address of the copyright owner or their authorized agent. If acting on behalf of the copyright owner, you must provide evidence of your authority to act in such a capacity as well as a statement that the request is being made on behalf of the copyright owner.

  2. Identification of Work: Identification of the copyrighted work(s) that you claim has been infringed, including the title of the copyrighted work and a brief description, the name of the copyright holder, and the date of publication or creation.

  3. Identification of Infringing Material: Identification of the material that you claim is infringing on your copyrighted work(s) and its location on our website. Provide the URL of the infringing content, the title of the content, and a detailed description of the infringement.

  4. Good Faith Statement: A statement that you have a good faith belief that the use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. Accuracy Statement: A statement, under penalty of perjury, that the information in the notification is accurate and that you are the owner of the copyright or are authorized to act on behalf of the owner.

  6. Signature: Your physical or electronic signature.

You acknowledge that if you fail to comply with all of the requirements of this section, your DMCA Takedown Request will not be valid.

Processing the DMCA Takedown Request

Upon receipt of a valid DMCA takedown request alleging copyright infringement, we will take whatever action we deem appropriate within our sole discretion, including:

  • Acknowledge receipt of the request within 48 hours.

  • Investigate the claim and determine if the content in question appears to be an infringement. We may request additional information before removing any material alleged to be an infringement.

  • If the content is found to be an infringement, we will promptly remove or disable access to the infringing material within 72 hours of receiving the notice.

  • Notify the user who posted the infringing content of the takedown request and provide them with a copy of the request in addition to notifying them that the content has been removed or disabled.

Counter-Notice Procedure

Should we or the user who published the allegedly infringing content believe that the material was removed or disabled in error, we or they may submit a counter-notice. The counter-notice should include the following information:

  1. The user’s full name, address, telephone number, and email address.

  2. Identification of the material that has been removed or to which access has been disabled and the location of the material before it was removed or access to it was disabled (e.g., the URL).

  3. A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

  4. The user’s physical or electronic signature.

Upon receipt of a valid counter-notification, we will provide a copy to the original complainant and inform them that we will replace or re-activate the removed material or otherwise re-enable access to it in ten (10) to fourteen (14) business days, unless the copyright owner files an action seeking a court order against the user/publisher of the said material.

Repeat Infringers

We reserve the right to terminate the accounts of users who are repeat infringers of copyright-protected content. We also reserve the right to cease providing services to any user we believe to be a repeat infringer. For the purposes of this Policy, a repeat infringer is a user of our Website whom we determined to have infringed the copyright or trademark rights of others two (2) or more times.
